1. Acceptance of Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("Customer," "User," "you," or "your") and Jet's Pizza ("Company," "we," "us," or "our"), governing your access to and use of the website jets-pizza.rest (the "Site") and all related services, features, content, and functionality offered by Jet's Pizza (collectively, the "Services").

By visiting the Site, creating an account, placing an order, subscribing to communications, or otherwise engaging with any aspect of our Services, you expressly agree to be legally bound by these Terms, our Privacy Policy (incorporated herein by reference), and any additional guidelines, policies, or rules posted on the Site. Your continued use of the Services following any posted changes to these Terms constitutes acceptance of those changes.

Jet's Pizza reserves the right to request proof of age at any time and to refuse service to anyone who does not meet this requirement.

2. Description of Services

Jet's Pizza operates as a food service business offering the ordering, preparation, and delivery or pick-up of pizzas, sandwiches, salads, sides, beverages, desserts, and other food and beverage items (collectively, "Products"). Our Services include, but are not limited to:

• Online ordering through our website at jets-pizza.rest;
• In-store pick-up and carryout services;
• Delivery services to eligible addresses within our designated delivery zones;
• Catering and bulk order services, subject to availability and advance notice requirements;
• Promotional programs, loyalty rewards, and special offers as announced from time to time;
• Customer support and communications via email, telephone, and other channels;
• Any other features, tools, or services we may offer in the future.

Jet's Pizza reserves the right, in its sole discretion, to modify, suspend, discontinue, or restrict access to any portion of the Services at any time, with or without prior notice, and without liability to you or any third party. We do not guarantee that the Site or any Service will always be available, uninterrupted, timely, secure, or error-free.

Menu items, pricing, availability, and delivery zones are subject to change without notice. Certain Products may be limited to specific locations, seasons, or promotional periods. Images of food items displayed on the Site are for illustrative purposes only and may not exactly represent the final product.

3. User Obligations and Prohibited Activities

3.1 General Obligations

As a condition of using our Services, you agree to:

• Provide accurate, current, and complete information when placing orders or creating an account;
• Maintain the accuracy of any information you provide and promptly update it as necessary;
• Use the Services only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations;
• Protect any account credentials (such as username and password) and not share them with any third party;

• Comply with all applicable food safety, health, and sanitation guidelines when handling delivered or picked-up Products;
• Ensure that a responsible adult is present to accept delivery where required by law (e.g., if any age-restricted products are ordered).

3.2 Prohibited Activities

You agree that you will not, directly or indirectly:

• Use the Site or Services for any fraudulent, unlawful, deceptive, or unauthorized purpose;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Transmit any unsolicited commercial communications, spam, or chain messages;
• Attempt to gain unauthorized access to any portion of the Site, other user accounts, or computer systems or networks connected to the Services;
• Use automated tools, bots, scripts, scrapers, or crawlers to access or collect data from the Site without our prior written consent;
• Interfere with, disrupt, or damage the integrity or performance of the Site or Services;
• Upload, transmit, or distribute any content containing viruses, malware, spyware, or any other harmful or destructive code;
• Use the Services to place false, fraudulent, or abusive orders;
• Engage in any conduct that restricts or inhibits any other person from using or enjoying the Site or Services;
• Circumvent or attempt to circumvent any security measures, access controls, or technological protections we employ;
• Copy, reproduce, modify, translate, create derivative works from, or exploit any portion of the Site without our express written permission;
• Violate any applicable law, statute, ordinance, or regulation, including without limitation consumer protection laws, privacy laws, or intellectual property laws;
• Use the Services in any manner that could harm our reputation, goodwill, or business relationships.

We reserve the right to investigate any suspected violation of this Section and to take any action we deem appropriate, including terminating your access to the Services, reporting conduct to law enforcement authorities, and pursuing all available legal remedies.

4. Account Registration and Security

To access certain features of our Services, such as order tracking, saved preferences, and loyalty rewards, you may be required to register for an account. When creating an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may not create more than one account per person for personal use, transfer your account to any other person, or use another person's account without their express permission and our authorization. Jet's Pizza reserves the right to refuse registration or cancel an account at its sole discretion, including in cases where we suspect fraudulent activity or violations of these Terms.

You agree to immediately notify Jet's Pizza of any unauthorized use of your account, any breach of security, or any other concern regarding your account's integrity by contacting us at [email protected]. Jet's Pizza will not be liable for any loss or damage arising from your failure to comply with these obligations.

5. Ordering, Payment, and Pricing

5.1 Order Placement

Orders placed through our Site or other ordering channels constitute an offer to purchase Products subject to acceptance by Jet's Pizza. We reserve the right to refuse or cancel any order at our sole discretion, including in cases of Product unavailability, errors in pricing or descriptions, suspected fraud, or inability to verify payment information. You will receive an order confirmation via the contact information you provide, which does not necessarily constitute formal acceptance of your order.

5.2 Pricing and Taxes

All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable federal, state, or local sales taxes, which will be calculated and added to your order total at checkout based on the applicable tax laws of the jurisdiction where the order is fulfilled. You are responsible for any taxes, fees, or charges associated with your purchase.

5.3 Payment Methods

We accept various forms of payment as indicated on the Site at the time of purchase, which may include major credit cards, debit cards, digital wallets, and other payment methods. By submitting a payment, you represent and warrant that you are authorized to use the payment method provided, and you authorize us to charge the applicable amount to that payment method.

5.4 Delivery Fees and Minimum Orders

Delivery orders may be subject to delivery fees and minimum order requirements, which will be disclosed at checkout. These fees and requirements are subject to change and may vary by location, time, or promotional period.

5.5 Refunds and Cancellations

Once an order has been placed and confirmed, cancellations may not be possible as food preparation begins promptly. If you experience an issue with your order — such as a missing item, incorrect order, or quality concern — please contact us immediately at [email protected]. We will evaluate each situation on a case-by-case basis and, in appropriate circumstances, may offer a replacement, store credit, or refund in our sole discretion. All refund and credit determinations are final.

6. Delivery Terms

Delivery is available only within designated delivery zones at participating locations. Estimated delivery times are approximations and are not guaranteed. Delivery times may vary due to weather conditions, traffic, high order volume, or other factors beyond our control. Jet's Pizza is not liable for delays in delivery caused by circumstances outside of our reasonable control.

It is your responsibility to provide a complete and accurate delivery address. Jet's Pizza will not be responsible for undelivered orders resulting from incorrect or incomplete address information provided by you. If you are not available at the delivery address and the driver is unable to complete delivery, additional fees or order cancellation without refund may apply.

Risk of loss or damage to Products passes to you upon delivery or upon your pick-up of an order at our location. We are not responsible for the condition of Products after they leave our possession.

7. Intellectual Property Rights

7.1 Ownership

All content, materials, and information available on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, and the overall appearance and "look and feel" of the Site (collectively, "Content") — are the exclusive property of Jet's Pizza or its content suppliers and are protected by United States and international intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable state intellectual property laws.

7.2 Trademarks

The Jet's Pizza name, logo, trade dress, slogans, and all related marks are trademarks or registered trademarks of Jet's Pizza in the United States and other jurisdictions. All other trademarks, service marks, and trade names appearing on the Site are the property of their respective owners. Nothing in these Terms grants you any right or license to use any trademark, service mark, or trade name without our express prior written consent.

7.3 Limited License

Subject to your compliance with these Terms, Jet's Pizza grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services solely for your personal, non-commercial use for the purpose of ordering food Products. This license does not include any right to:

• Resell or make commercial use of the Site or its Content;
• Collect or use any product listings, descriptions, or prices;
• Make any derivative use of the Site or its Content;
• Download or copy account information for the benefit of another merchant;
• Use data mining, robots, or similar data-gathering and extraction tools.

This license terminates automatically if you violate any provision of these Terms or if we revoke it at our sole discretion. Any unauthorized use of the Site or Content immediately terminates the license granted herein and may subject you to civil and criminal liability.

7.4 User-Submitted Content

If you submit, post, or otherwise provide any reviews, feedback, comments, suggestions, photos, or other content to us ("User Content"), you grant Jet's Pizza a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with our business and marketing activities. You represent and warrant that you own or have the right to grant this license and that your User Content does not violate any third-party rights.

8. Disclaimers and "As-Is" Basis

Jet's Pizza does not warrant or make any representations regarding the quality, safety, accuracy, or reliability of any Products, nor that Products will meet your specific dietary needs or preferences. Menu descriptions and allergen information are provided for general informational purposes only. If you have food allergies, intolerances, or dietary restrictions, it is your responsibility to contact us before placing an order. Jet's Pizza is not liable for any adverse reactions to food consumed.

Some jurisdictions do not allow the exclusion of implied warranties; therefore, some of the above exclusions may not apply to you. In such cases, Jet's Pizza's warranties are limited to the greatest extent permitted by applicable law.

9. Limitation of Liability

Even if Jet's Pizza has been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed its essential purpose, our total cumulative liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of: (a) the total amount you paid to Jet's Pizza in the thirty (30) days immediately preceding the event giving rise to the claim, or (b) One Hundred Dollars ($100.00 USD).

The limitations of liability set forth in this Section reflect a fair allocation of risk between the parties and form an essential basis of the bargain between the parties. These limitations apply regardless of the legal theory on which a claim is based, whether in contract, tort (including negligence), strict liability, or otherwise. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, franchisors, franchisees, licensors, and service providers (collectively, "Indemnified Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, expenses (including reasonable attorneys' fees and court costs), and penalties arising from or related to:

• Your use of or access to the Site or Services;
• Your violation of any provision of these Terms;
• Your violation of any applicable federal, state, or local law, regulation, or ordinance;
• Your infringement or misappropriation of any third-party intellectual property, privacy, or other proprietary rights;
• Any User Content you submit, post, or transmit through the Services;
• Your negligence, willful misconduct, or fraud;
• Any dispute between you and a third party arising in connection with the Services.

Jet's Pizza reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with our defense of such matter. You must not settle any claim subject to this indemnification obligation without our prior written consent.

11. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, available on the Site, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, share, and protect your personal information. By using the Services, you consent to the collection and use of your information as described in our Privacy Policy.

To the extent you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including rights of access, deletion, correction, and opt-out of certain data practices. We comply with the Federal Trade Commission Act (FTC Act, 15 U.S.C. § 41 et seq.) and all applicable federal and state privacy and consumer protection laws in connection with our collection and use of personal information.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which the relevant Jet's Pizza location is situated, without giving effect to any choice-of-law or conflict-of-law rules or provisions that would cause the application of any other jurisdiction's laws.

Subject to the Dispute Resolution section below, you consent to the exclusive personal jurisdiction and venue of the federal and state courts located in the applicable state of operation for any legal action or proceeding arising out of these Terms or your use of the Services. You waive any objection to the laying of venue in such courts and waive any claim that such courts are an inconvenient forum.

Our Services are operated from within the United States and are intended for users located in the United States. We make no representations that the Services are appropriate or legally available for use in locations outside the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact Jet's Pizza at [email protected] and attempt to resolve any dispute informally. We will make reasonable efforts to resolve disputes amicably within thirty (30) days of receiving your written notice describing the nature and basis of the dispute and the relief sought.

13.2 Binding Arbitration

If we cannot resolve a dispute informally within thirty (30) days, both parties agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Services (collectively, "Disputes"), shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org, except as modified herein.

The arbitration shall be conducted in the English language. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could award, except that the arbitrator may not award relief in excess of or inconsistent with these Terms. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.3 Class Action Waiver

If a court decides that applicable law precludes enforcement of any of the limitations in this Section with respect to a particular claim, then that claim — and only that claim — shall be severed from the arbitration agreement and may be brought in court, subject to the applicable statute of limitations.

13.4 Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court. Either party may also seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

13.5 Time Limitation on Claims

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE, OR IT SHALL BE FOREVER BARRED, NOTWITHSTANDING ANY STATUTE OF LIMITATIONS OR OTHER LAW TO THE CONTRARY. WHERE APPLICABLE LAW PROHIBITS SUCH LIMITATION, THE SHORTEST PERMISSIBLE LIMITATIONS PERIOD UNDER SUCH LAW SHALL APPLY.

14. Term and Termination

These Terms become effective when you first access the Site or use the Services and shall remain in full force and effect unless and until terminated as provided herein.

Jet's Pizza may, in its sole discretion, at any time and for any reason, with or without notice to you:

• Terminate or suspend your access to all or any part of the Services;
• Deactivate or delete your account and all related information;
• Refuse to provide any or all Services to you;
• Discontinue the Site or any portion thereof.

Grounds for termination may include, without limitation, your violation of these Terms, suspected fraudulent activity, creation of risk or legal exposure for Jet's Pizza, extended periods of account inactivity, or a decision by Jet's Pizza to cease operating the Services.

You may terminate your account at any time by contacting us at [email protected]. Termination of your account does not relieve you of obligations incurred prior to termination, including payment for orders placed before termination.

Sections of these Terms that by their nature should survive termination shall survive, including without limitation: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and Miscellaneous provisions.

15. Changes to These Terms

Jet's Pizza reserves the right to modify, update, or replace these Terms at any time and for any reason, in its sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where practicable, provide additional notice — such as via email to registered account holders or a prominent notice on the Site — prior to the changes becoming effective.

Your continued use of the Site or Services after any modifications to these Terms are posted constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must immediately discontinue your use of the Services and, if applicable, close your account.

We encourage you to review these Terms periodically to stay informed about our current policies. Your continued use of the Services following the posting of any changes signifies your acceptance of those changes.

Your access to and use of third-party websites and services is governed solely by the terms and conditions and privacy policies of those third parties. We strongly encourage you to review the terms and privacy policies of any third-party sites you visit. Your use of third-party sites is at your own risk, and Jet's Pizza expressly disclaims all liability arising from your use of such sites.

17. Force Majeure

Jet's Pizza shall not be liable for any delay, failure, or interruption of Services resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, fires, floods, earthquakes, pandemics, epidemics, quarantines, governmental actions or restrictions, labor strikes or disputes, power outages, internet or telecommunications failures, cyberattacks, civil unrest, war, terrorism, or any other similar events ("Force Majeure Events").

In the event of a Force Majeure Event, we will use commercially reasonable efforts to resume the affected Services as promptly as practicable. However, we shall have no liability to you for any losses, damages, or inconvenience resulting from a Force Majeure Event.

18. Allergen and Nutritional Information

Jet's Pizza makes reasonable efforts to provide accurate allergen and nutritional information for our Products. However, our food products are prepared in facilities that handle common allergens, including wheat, milk, eggs, peanuts, tree nuts, fish, shellfish, and soy. We cannot guarantee that any Product is entirely free from allergens or cross-contamination. If you have a severe food allergy or dietary restriction, please contact us before ordering. By placing an order, you acknowledge that you have reviewed available allergen information and accept full responsibility for your food choices.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, void, or unenforceable for any reason, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall remain in full force and effect.

The parties intend that every provision of these Terms shall be enforceable to the maximum extent permitted by applicable law. In the event that any provision is found to be unenforceable, the parties agree to replace that provision with an enforceable provision that reflects the original intent of the parties to the greatest extent possible.

20. Entire Agreement and Waiver

These Terms, together with our Privacy Policy and any other legal notices, policies, or guidelines published by Jet's Pizza on the Site, constitute the entire agreement between you and Jet's Pizza with respect to the subject matter herein and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Services.

No waiver by Jet's Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or any other term, and any failure of Jet's Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. A waiver is only effective if it is in writing and signed by an authorized representative of Jet's Pizza.

21. Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms, in whole or in part, without Jet's Pizza's prior written consent. Any purported assignment in violation of this Section shall be null and void. Jet's Pizza may freely assign these Terms and all of its rights and obligations hereunder, including in connection with a merger, acquisition, corporate reorganization, sale of assets, or operation of law, without notice to or consent from you.

22. Electronic Communications

By using the Services, you consent to receiving electronic communications from Jet's Pizza, including via email, push notifications, text messages (where applicable), and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You may withdraw your consent to receive certain marketing communications at any time by following the unsubscribe instructions included in such communications, though we may continue to send you transactional and service-related messages.

23. Headings and Interpretation

The section headings in these Terms are for convenience only and have no legal or contractual effect. The use of "including" or "include" in these Terms means "including without limitation." These Terms shall be interpreted without strict construction for or against either party, regardless of which party drafted the relevant provision.
